Perspectives on SCOTUS’ vaccine mandate decisions

January 13, 2022

~ 4 minutes read

The debate following the ruling focused largely on the decision to block the federal vaccine-or-test mandate.

What does each side see as fact?

A vaccine-or-test mandate keeps workers safe and healthy in the workplace.

Biden’s vaccine mandate is an unconstitutional infringement on bodily autonomy.

The Narrative

Blocking Biden’s vaccine mandate shows that the Supreme Court doesn’t care about people’s safety. COVID-19 is a major risk for people who must work in-person.

This is a huge win for freedom, federalism, and the rule of law. The mandate placed an undue burden on private sector employers and millions of workers.

How could a reasonable person come to think this?

COVID-19 is a major threat in all areas of life, and the government should take necessary actions to ensure that all people, and vulnerable populations in particular, are safe.

The Biden administration is using the pandemic as an excuse to implement a number of invasive policies that limit civil liberties.

To the left, COVID-19 is a major threat in all areas of life, and the government should take necessary actions to ensure that all people, and vulnerable populations in particular, are safe.

To the right, the Biden administration is using the pandemic as an excuse to implement a number of invasive policies that limit civil liberties.

Our view of today’s Supreme Court decision is, to a large extent, shaped by our view of the pandemic, vaccines, and the federal pandemic response more broadly.
